Deck Installation Rip Off. Made Deposit but no deck and no refund

On July 4, I purchased a deck installation from the Home Depot in Newton, New Jersey, and put down a $2K deposit. I was assured that Home Depot would apply for all the necessary permits and that once the permits were approved, the work crews were only 3-4 weeks out.

As it neared mid August and I had heard nothing from Home Depot, nor from US Home Systems, which is apparently the company to which Home Depot Installation services outsources it's customer service, I called to find out the status. I was told that they were still waiting for permit approval, and that I would be contacted once the permits were approved.

The last week of August, I again contacted US Home Systems and was told that the permits has been approved as of August 26th, and that I would be contacted to schedule the installation. Several weeks passed and I was never contacted.

Again I followed up with US Home Systems and was told that the permits were rejected because they did not have an original plot plan. I had supplied a copy of the plot plan when the deck was first purchased and no one ever contacted me to get an original.

I was told that Home Depot could not install my deck and I had the option to cancel with a full refund of my deposit, which would take 14 to 21 days. I was finally able to get specific information out of US Home Systems that the cancellation was processed on 10/12 and that a check would be issued within 14 to 21 days.

It is now November 15th and I have no check and neither Barbara Hamell, nor Kay Jones, Barbabara's supervisor, in the customer care department will return my calls. Barbara Hamell has made many promises to me about the issuance of my check, but all promises have been unfulfilled.
