Ipoff kept deposit to hold a house contingent on purchasing a lot. The purchase of lot deal failed

On Dec. 20, I made a deposit of $5000 to Ridgeway Homes to hold a modular house for me. This was contingent on my purchasing a lot right next to my lot.

On Dec. 21, the person in charge of the lot could not sell because of a lien on the property. I immediately called the sellsperson, Doug, to let him know that I changed my mind about buying the house.

I was told by Doug that their part-time bookkeeper was not in and that my money would be returned soon. I talked to Doug and another person at the Ridgeway office several times.

I was told that T.A. Pedersen is the owner. I wrote to him about the situation January 27 and he answered me on January 30.

He wrote four paragraphs in his letter. I will write a few things he told me.

"Even though I feel that we had a legally binding contract, it is my intention to refund some proportion of your downpayment reduced by the expenses we incurred in time, effort, communications, and actual out of pocket expenses. We will send you the net amount due at some future date within the next sixty to ninety days as it becomes available in our cash flow process.

Please recognize that we are in the middle of winter, our slowest business time, and cash flow is constricted, therein the extended amount of time required to send you the net amount due."

I swore a Warrant In Debt (Civil Claim for Money) on Feb. 17 for April 18. I found out from the Judge and Ridgeway lawyer that I had sued the wrong persons.

I was told to write a letter to Ridgeway Homes for the money to the same address that I had written to before.
