Ripoff property damage poor work ripped off money didn't pay subs

Work on my pool was started October. During this ordeal sprinkler heads were broken for no reason and not repaired, And 2 foot deep into the ground next to my foundation was dug and left wide open. No sand was put back to replace the supporting dirt for over a month.
My house foundation has move greatly because of this.
Dealing with this man is extremely aggravating and frustration at its worst state.

Things called for in the contract we did because
He never showed up to get it done before concrete.
He talks in circles and does not know the products he sells or installs. He knows not how to fix problems
that his subs cause and then blames us.

My contract was for $33,300. $22,746 has been paid to Mr. Berg to date of February 2. Left undone as called for by contract is the electrician, pool plaster with 50 % mix of 3m product, All the equipment such as filters, pumps, etc. Outside contractor estimates came to around a $13,000 figure to complete the remaining products and work. Mr. Berg has $10,554 left on this contractto accomplish these requirements. YET.
The deck he says is still not paid for at all ($7000).
If paid it would leave $5154 to complete the above expenses contractually required.in ADDITION The deck has a product called KOOL DECK that is pealing and chipping off everywhere. The deck is humped like a paved road (not level or nearly level) despite my complaints while it was being poured.

Consequently, our furniture leans 10 degrees in different directions. AND the deck man slopped Kool Deck
all over our new house paint and our fence, and then could not see the problem to clean it off. Mr. Berg demands $3500 to repair what his subcontractor screwed up. If not he will not honor the remainder of the contract.

We do not at this point trust Mr. Berg at all.
We believe that like many contractors, he now will take our money (that is not merited at this time) and pocket it without paying subs or completing the contract.
At this point it is obvious in black and white figures
that Mr. Berg is ahead on the contract payments,
yet demands more or he will walk.
