This is to acknowledge the receipt of your letter dated October 31, regarding the referenced subject matter. Im very disappointed to hear of your decision. This serves as my last and final attempt to resolve this matter regarding my 2006 Maxima transmission problem before moving forward with a legal law suit against Nissan North America, Inc. Corporate.

The vehicle has lost transmission power at 67,000 (low) miles. This has caused a financial burden due to the large balance owed to GM Financial and Im unable to drive the car. This has placed me in a situation were Im forced to purchase another vehicle, pay local taxes and carry full insurance coverage on a car that will not operate to its full capacity. The car is grounded to avoid a deadly accident to myself and potential innocent victims.

I did not purchase an extended warranty due to my previous excellent experience with two other Nissan vehicles. I was thrilled to have purchased the 2006 Maxima until January.

The manufacturing defect of the 2006 Maxima transmission is poor. My local dealer (Browns, Sterling Nissan) as advised me to sell the car for parts due to its low trade in value and they also believe the engine is failing. The car has failed me and other Nissan owners who are hard working consumers (as noted in the attached complaints).

Nissan has issued a CVT transmission announcement (see attached). According to Nissan customer service representative the CVT transmission applies to replacement of manual transmissions. All Nissan owners who have experienced the same issues and should receive the same Powertrain 10 years / 120,000 miles whichever comes first warranty protection. Please consider a recall of all 2006 Maxima transmissions to show good faith to all your customers who purchased this defective product.

I hope for a reconsideration and positive resolution and outcome to this nationwide safety concern.
