Felipe Gonzalez Refused to fix convertible roof damaged on their property while in their care

I took my care to Flips for repairs. On May 31st they suggested it would be better if I did not drive it much so we decided to leave it there. They told me they would have the part the next day but then the next day they contacted me stating they had to order it and would take a week to get the part. They needed the money for the part that day to order it. I dropped off the check. 10 days later I had not heard a word from them so I called to find out the status of my vehicle.

I was told they were having difficulty locating the part and it could be up to a month to get. After another week I called back but still they had no news on a part. After another bit of time I called again. This time I got a text back stating that they had found the part and it was on the way but that the owner would be out of town for several days. They promised to have the car to me by July 4th. On the 5th of July I still have not heard from them so I again contacted them.

They told me that the car was still not done as the owner (who has another full time job) was working mandatory overtime. They told me they would have the car by Sunday. I had plans to go out of town for a family birthday party so I asked if they could have the car by Saturday. They told me they would try. I got texts stating they could not have the car until 10:30 am Sunday then received another text on Sunday stating they could not have it until noon, then again I got a text stating they were having issues and it was going to take later. We finally picked the car up at 4:45pm on Sunday July 9th.

At this time my son noticed cuts (2 long ones that went all the way through both layers and one small that only went through one layer) in the convertible top of the car. I contacted Flips and they first told me they would turn it into their insurance but the next day they told me I would have to take them to court. They tried to claim the car came in that way 5 weeks ago and yet it had no water damage after they left it outside. This damage (most likely vandalism) happened on their property while in their care.
