Emich VW fraudulenty filled out extended used car warranty which cost me $5500
My wife, Joy Wegs, and I, Scott Wegs, purchased a used 2004 VW Pasat GLX 4motion from Emich VW in Denver, CO on 4/7. At the same time, we also purchased a "used vehicle plan" extended waranty offered through Zurich. The used vehicle plan, according to the terms and conditions was supposed to cover the car for 36 months or 75,000 miles plus the existing mileage on the vehicle at time of purchase (75,000 45,890 = 120,890 miles) In September our car required significant mechanical repairs totaling $5,500 when the car had approximately 80,000 miles. At that time I called Zurich to see how to to handle these repairs and was told that our warranty was expired, but should not have been according to the paperwork I received at time of purchase. I did further research and found that the original paperwork was forged and resent by Chris Condon, finance manager at Emich VW after the time of purchase which changed the paperwork conditions from a "used vehicle plan" to a "new vehicle plan" which according to Zurich terms and conditions means that the coverage would then expire when the length of time or accumulated mileage of the term is reached (75,000 miles). These changes were fraudulently made without Scott or Joy's consent or knowledge. When I initially approached Fred Emich, owner of Emich VW, in September I was dismissed and ignored. I followed up again with Volkswagen of America Customer Care and Chris Condon in December and was told via email on 30 Dec by Chris Condon that "we (Emich) would do the repairs at the dealership" and on Jan 12 that the transportation expense from Grand Junction CO to Denver Co would be paid for by either Emich VW or Chris Condon personally as "I (Chris) am the one who made the mistake on your paperwork." After the car was transported to Denver at my expense, Fred declined to assist us with repairs but instead offered to refund the money we spent on the warranty, $1,688.
We had the car towed to and repaired by A1 Engine and Transmission in Commerce City CO. The engine was rebuilt and the expenses for that repair not including transportation total $5,500 and I am seeking reimbursement from Emich VW for expenses incurred.
