11 weeks and haven't received refund yet

I responded to a radio ad offering extended vehicle warranties. The sales techniques were very high pressure and basically said if you don't buy right then on the phone they will have to put your name on a list and you would not be able to purchase a warranty.

After being told that I could cancel if I thought about it over the weekend I gave a credit card number for the down payment of $125. I was told that if I changed my mind "we will just credit the down payment back to your card". This was late on a Friday afternoon.

The following Monday morning as soon as I could get in touch with the company I said I wanted to cancel and have the down payment credited back to my card. The response was that the policy number had already been issued so they couldn't credit the card until they received a written notice of cancellation from me. After arguing that no one told me that in the initial call they said "we're just customer service, we don't have anything to do with what the salesmen say".

I wrote the letter of cancellation and mailed it to the company. After about a week I called to see if they had received it and they had. At this point I was told it would take 30 business days to process the refund. Again after much arguing and a lot of "sorry it's just our policy" I gave up.

After 30 business days I called to check on the status of the refund and was told that "the processing department is running behind due to a system upgrade". Again much fruitless arguing.

One day short of 11 weeks since I cancelled the policy I called again to check refund status and was told "our records show no refund is due because we never received the funds from your account. The credit card was declined". Of course that was not true because my bank showed the $125 charge almost as soon as I got off of the phone on the initial call. Once again, 30 minutes of choice words and talking to this manager and that, I was told that I would have to fax in a copy of my bank statement showing the charge.

Next day faxed the copy of bank statement and called to make sure they received it. They said they had and that a manager would review it and give me a call. I refused this and asked to speak to the manager who I knew by name at this point. Manager said the refund would be issued and would take about 5 days. That was today so I don't actually have the money yet and really don't believe it will show up in 5 days or 5 weeks.

Based on my experience, I would run, not walk, away from this company as fast as I could.
