They never put in any transmission fluid when doing my tune-up/oil change

I went in for an oil change/tune-up they were to top off all fluids but it seems that they never put in any transmission fluid. While driving the care it was slipping gears, so I went back to Pep Boys and they said that I needed to replace the transmission I then went to have it checked out by creedens in salem, who work only on transmissions, and he told me that when he took of the cap to check the level of fluid that it was smoking and there has not been any fluid in there for a long time which means they never checked the level or put in any transmission fluid when they did the Preventative Maintenance Service.
