Nissan terminates my new vehicle warranty after 2 months and less then 3,000 miles because they can!

1) December 9th I had purchased a 2006 Nissan Armada Se-4X4 Off-Road Edition from Riverside Metro Auto Group LLC, they are certified Nissan and Infiniti Dealers, they are located in Riverside CA just outside of Los Angeles, CA. I have all the documentation from the deal, the bill of sale clearly states it is a NEW vehicle, I have a signed odometer statement clearly stating the vehicle had 28 miles. I paid $35,900 pre tax which included a Lo-Jack tracking device to be installed with 10 days which was installed I gave the dealer a check for 900.00 and financed this deal through NMAC @ 4% for 60 months.

2) Approximately March I paid the Loan for the vehicle in full.

3) Unbeknownst to myself Nissan USA terminated my New Vehicle Warranty approximately February 10th. Nissan Consumer Affairs is and has refused to send me any documentation, Nissan failed to notify me, I received absolutely no notification and had absolutely no idea this had accrued,

4) Approximately May I received a California Title for the vehicle.

5) August 10th I relocated to the East Coast, I had decided I would take some time and drive the Armada cross country.

6) September I took the Armada to my Local Dealer on the East Coast Acme Nissan for a regular oil change and I also to repair the backside of the Passenger seat. There was a seam in the leather that was opening. It was at this time that I was first advised this Vehicle had no Warranty.
I aways had the vehicle serviced at Nissan Dealers, every 3 thousand miles I had the oil changed, even had the 7,500 miles service 15,000miles etc factory service and always at Nissan dealers, and no dealer ever told me of any warranty issue although I never asked for any warranty work until September.

7) I immediately contacted Riverside Metro Auto Group LLC, after they looked into the matter they came to conclusion that the California DMV had branded the Vehicle as NOT ACTUAL MILAGE, they told me that it was an error by the DMV and they would fix the situation. Riverside Metro Auto Group LLC, explained the situation to Acme Nissan and Acme Nissan agreed to fixed the seat while this was being worked out.

Within the next couple of days Riverside Metro Auto Group LLC contacts me and requests I send them a copy of the California Title. When I arrived in New Jersey I had by Law 10 days to register the vehicle and so when applying for a New Jersey registration I had no choice but to surrender the California Title to the New Jersey DMV. Riverside Metro Auto Group LLC then requested I send them a copy of the New Jersey Title, which by the way says the vehicle is of actual mileage. Riverside Metro Auto Group LLC told me they had sent a copy of the Title to Nissan and the warranty was going to be reinstated, but they were still having trouble getting CA DMV to remove the NOT ACTUAL MILLAGE in their records. I had also tried on many occasions to get CA to remove this in their records I had spent more hours on hold then I care to remember. Riverside Metro Auto Group LLC had then informed me that my warranty was reinstated, but after rechecking I had found out that in fact the Warranty was NOT reinstated. After having many more conversations with Riverside Metro Auto Group LLC, including someone who claims to be the owner I have still gotten nowhere in terms of my Warranty.

8) By now I'm totally fed up and I decide I just want to trade in this Armada, yep no one will touch it, every time someone runs a report it comes as NT ACTUALL MILAGE, everyone tells me I'm screwed that the vehicle is pretty much worthless. Now I'm even more pissed off, I call the dealer back, they blow me off, again there is nothing they could for me and the owner of Riverside Metro Auto Group LLC is sorry for my trouble but he says he has done everything he can.

8) Finally May 19th 08 after hours of being transferred around the head office in the CA, DMV which is in Sacramento I get lucky and I come in contact with really super nice woman in an investigation support unit, (you would think someone would have directed me to this unit before) anyways I tell her my story and give the VIN etc and she tells me she will look into it for me and call me back.

Well about a hour later I get a call back from her, she had researched the micro film and found that in fact the DMV had made a mistake. She told me she was going to immediately adjust the records to show that the vehicle did have the actual millage.

She also sent me a letter which states that they had made an error and that this vehicle should not have been branded as NOT ACTUALL Millage and that the vehicle history record is clean.

9) I contact Nissan Consumer Affairs, I have spoken with 3 different agents and 1 supervisor, even though I now have this letter from the CA DMV, they still refuse to reinstate the Warranty. Again I contacted Riverside Metro Auto Group LLC, they are now starting to get a little worried because they checked with the CA DMV and the record for the Vehicle is clean, they also contacted Nissan Consumer Affairs and have they can't get them to reinstate the warranty either even though the CA DMV record has been fixed and it was clearly a mistake.

10) After thinking about this, no matter what happens now this Armada is branded and is worthless. The reason I come to this conclusion is because even Nissan USA / Nissan Consumer Affairs is giving me a hard time (to put it mildly) so if Nissan who knows dam well the history is giving me such a hard time. To test my theroy I brought the vehicle to an Infinity dealer near me, they ran a car fax and questioned me about it, even after I showed all them all my documentation they still don't want the car, I did the same with a BMW dealer and had the same response.

I would like to know,
can I force Nissan or the dealer to take the truck back and give me a full refund plus damages for all my anguish and heart ache over this matter.
For heaven sakes, I paid $36,000 for a Brand new truck, 2 months after that Nissan terminates the new vehicle warranty, even the power train warranty is was cancelled!
