Deceptive sales practices Ripoff

Cars & Transport

I entered Nissan of Statesville on May 4th with the intent of purchasing a new vehicle. I decided on a 2007 Nissan Maxima SL.

The arrangement made with the salesman was for a 39 month lease with option to purhase that would have totalled 60 monthly payments at x dollars.

Promises were also made to fix a scratch on the dashboard, and reimburse me with a check to payoff another vehicle I had a loan on.

In the finance managers office, I agreed to purchase additional warranty and a maintenance plan for the vehicle. Gap coverage was also included in the deal. This changed it from 60 payments to 62 payments still at the same x dollar amount.

Once the contract was printed I specifically asked the finance manager if the contract in front of me stated that I would own the vehicle after the 62 payments were made with no mileage charges and no additional fees. He answered yes to my question.

I signed the paperwork, but was denied access to them following that. I had to leave the dealership with nothing but a "we owe" document stating that they would fix the scratched dashboard and provide me with the check for the other vehicle's payoff.

Some four weeks after the purchase, I finally have a copy of my contract. It is not an original but a poor photocopy. Following review of the contract I have found that the lease was not set up as a 39 month lease, but is in fact a 62 month lease.

There is a mileage allowance after which I have to pay $0.25 per mile if turning the car in.

The purchase option is a further $12000.00 after the 62 payments of x dollars.

They have provided me with the check, but they still have not fixed the scratched dashboard.in fact every time I question them about it I am told a kit is on order that will resurface the dashboard.

I am very skeptical that such a kit even exists. When I checked with the parts department they said that nothing was on order for my vehicle. The salesman saw me talking with the parts department and told me that the owner of the dealership had placed an order for four of these kits on his personal credit card. I find this very hard to believe.

In addition I recently found that one of the cargo nets as pictured in the manual for the vehicle was not provided. There is a total of three cargo mats and I only have two.

During the process of filling out the paperwork I repeatedly informed the finance manager that my mailing address was not the same as my physical address. They filed all of my paperwork with my physical address so I have not received any mailings from Nissan, the bank or anyone. Upon informing the dealership of this mistake they told me that I would have to call all of the parties myself to rectify my address situation.

I am wondering if the NC Unfair or Deceptive Trade Practices law will cover a situation like this, especially as I asked a direct question to the finance manager and was given an incorrect answer.

Nissan of Statesville are certainly not concerned about customer satisfaction.
