We started shopping for a QX SUV in January. After looking and finally deciding on the truck we decided to purchase by going back to the first dealership that where we started looking. We had a trade-in with a loan balance, a Cayenne.

After shopping around I just wanted them to match the other offers. I wouldn't get any money for my trade, it would be a wash. That is what was agreed to. We also agreed on a price. $53,900. After agreeing on price and the trade (wash) the games started.

I added lojack, satellite, alarm, etc. To bring up the total. No problem. When I looked at the contract on pickup I saw an amount for my trade, $3182. I questioned it because it should have been a wash but was assured that this is the way contracts are worded. They are paying off chase (my bank) so they have to show something for an amount. I was rushed through the paperwork but still assured that everything was above board. I did sense the discomfort in the salesman.

I called back the same day then a day later because it was clearly fraud. I will use even numbers to keep things simple. My payoff amount was $40,000. The sales price was $53,900. My extras brought my price up to $56,000. On a straight sale without a trade I would pay sales tax on $56,000 bringing my total to about $60,000. Since I already paid sales tax on the $40,000 trade (remember the wash?) I should be paying sales tax on the difference between the two cars.in NY it would be 8.75% of $16,000. I put down $1,000. My total note should have been about $57,500.

They only gave me on paper $37,000 for my trade, adding back the $3,000 difference from my payoff to the price of the truck. When I questioned this they said that they "gave" me a credit of $3000 for sales taxes as a favor. They didn't give me anything. It is normal to pay sales tax on the difference between the trade and the new car.

After double talk, side talk and everything in between the sales rep admitted that this is how they write their deals when a trade is involved. They kept trying to say that it matched the montly payment amount. I didnt care about a monthly pmt. I can pay cash for the car. The monthly pmt issue is a way to hide profits in a deal.

The rep admitted over and over that this gives them the chance to "book" more profits because they are showing a smaller tradein amount. Most people will not pick it up since for a straight sale the total outlay is the sam. I picked it up because the total dollar amount is $3000 more than it should be.

Through it all I never heard from a sales manager, owner etc. I don't need the $3000 as much as them. Luck for me I have actual recordings and records of every conversation including the convo in the dealership regarding the deal. I didn't argue with them any further. I am turning over my evidence to news 12 and a few other people so that they can be on TV. Maybe it is enough to be on TV, maybe not. I don't need the money. It would have been the same outlay without a trade.
They are cheating customers by not disclosing important information in their contracts.
