Cars & Transport

I park in a downtown garage where my car was stolen on February 22. It is the requirement of the parking garage that you leave your keys in the ignition and the car door unlock so they can park the car for you. I paid for my parking in advance so I would have a speedy exit at the end of the day.

At the end of the day I return with my receipt in order to retrieve my keys and my car in order to leave. I was told they could not find my key or my car. At that time the parking attendent told me she was the only one working that day. She was parking cars and handling the cashier's job as well. This parking lot holds about 200 cars. I was also informed by the security guard that he does not start until 2:00 pm in the afternoon, which meant that there was only one person handling the parking of cars, acting as the cashier as well as acting as the security guard. I did not have privilege to this information until the end of the day when I returned to pick up my car.

The parking attendent gave me cab fare to get home that night and cab fare to return to work that morning upon the promise to have a rental car for me that evening upon leaving work.

I received the rental car on the afternoon of February 23. The following day February 24th I received a call from the Chicago police to call the Madison police because they found my car in Madison, Wisconsin. I call the Madison police and they told me to call a towing company they had possesstion of the car. I called the towing company and they said they could not release the car until the police gave consent.

To make a long story short the parking lot owner Insuranace company (Chubb Insurance) call me to take a statement of what happen and told me that they would bring the car back and I could a the damages assessed and submit a estimate for repairs.

I submited a damage estimate but they are only willing to pay for damages they deemed were caused during the theft of the car.

The damages were a dent in the roof of the car, a cracked front bumper, a cracked side view mirror, the alarm system wires under the dash board were reaped out and the brakes had a grinding sound in them.

The insurance company will only pay for the mirror, bumper and the roof of the car.

I have a 1993 Mazda MX3 which I purchased in 1996 and was in mint condition and garage kept.

What recourse do I have to get the repair done.
