Oil left out of 1992 GMC 5 speed transmision when serviced

I carried my 1992 GMC 4wd truck 5 speed transmision, In for service and everything working fine. I picked up my truck and drove from Gainesville Ga. To Cleveland Ga. About a5 miles into the trip it was getting hard to shift the gear. Then started making noise (Roar) I stoped in at a service center in Cleveland Ga. Where the owner (he says he will testify) said there is no oil in your transmision. He also said the drain plug had been out but the fill plug had not been out (Dry Mud was in the fill plug). I called the GMC Dealer that did the service. Service mgr. Said no way. What am I to do now. I have made many contacts to the GMC Dealer. Last time service Mgr. Said sue if you like.
