"Thank you for your e-mail. We apologize for any inconvenience you may have experienced.

We understand having a cost effective account is important to you and we will be more than happy to discuss other options such as overdraft protection, however, the overdraft fees will remain in your account.

Our account records indicate that the account in question does not currently have Overdraft Protection. Overdraft Protection is not automatically part of an account and must be requested in order to be set up.in order to set up Overdraft Protection, it is necessary to have a Credit Card or a Savings account. Overdraft Protection involves the linking of one of these account types to your checking account so that funds can be transferred from the linked account whenever an overdraft situation occurs.

To open one of these accounts and apply for Overdraft Protection please visit our website at http://www.bankofamerica.com/deposits/checksave/

Please note that per the Deposit Agreement and Disclosures agreement, which governs your account with Bank of America, we are not obligated to pay an item presented if your account does not contain sufficient available or collected funds, but we may pay it at our option and charge you a fee.

As of April 9, overdraft or insufficient funds fees are assessed against your account based on the number of overdraft fee occurrences on your account as shown below:

- 1-2 occurrences: $16.00
- 3-5 occurrences: $30.00
- 6 occurrences: $33.00

An occurrence refers to the number of days with an overdraft or insufficient funds item presented against your account during the preceding 12-month period. The rolling 12-month period includes the current calendar month plus the previous 12 calendar months.

If we may be of further assistance, please contact us again by e-mail. Thank you for choosing Bank of America.

Sincerely,
