Overdraft fee posted before overdraft, causing to be overdraft!

I had been charged 99 dollars in overdraft fees when my account was positive 25.73 on 12/28on 12/29 deposited 50 dollars from savings to cover an item I forgot. I signed up for overfradt protection with my savings account. On 12/29 The next charge to the account is the overdraft fee of 99 dollars... So now I am -23.27 Then on 12/30 2 charges and 1 deposit for a balance of 1154.48. Does this make sense to you? Sure its after christmas my funds were low, but it only went under the balance after a charge of 99.00 of an overdraft fee. This can not be legal, any advice? Cant we all gather together for a class action law suit? Isnt this the rich get richer the poor get poorer. Oh now they say I can not be protected with my overdraft protection plan because I opened my checking and savings accounts in 2 different states. WTF!!! I want a lawyer. Looking over my account and fiances account we both had this happen, him 250 last month and me 99, hell times are tough 350 dollars is a big deal to us. HELP! Anyone know of a bank with a good debit card, savings plan and does not do this to its customers, I need to switch ASAP
