Ripoff fraudulent billing

On January 8 I called Capital One Cards to close my account. I spoke to a rep who said an annual fee would be waived If I paid my balance in full before Jan. 18. Payment was made and posted to the account prior to Jan 18.
Two month later I receive a bill stating that I have two late charges and the annual fee was never waved.
Isn't this theft?
