Failure to refund money with the modification not going though

We got in touch with Evan Lewis, of Us Mortgage Funding from a television ad, then he sent us the paper on our e-mail address. We then filled out all the papers and agreed to let them handle the modification for us. We were not to have any contact with our mortgage company, Citimortgage, which we didn't. We might have talked to them three times after they got all the papers they needed along with the $1500.00 fee for the service. Which we were told and it is in the papers that we received, that there would be a 100% refund if it did not go though. We waited and didn't receive any word from Evan, but our mortgage sent us an letter letting us know that they did not see any reason for the modification, so they did not approve. I called Evan that night, which was July 20th He told me he would check into it and call me that night or the next morning. This is August 26th, and I have not heard from him at all. I called him almost everyday asking for a return call, he never did. And yesterday I found out that the phone number 1-443-501-1513 had been disconnected. I called channed 6 for help on this and she sugguested that we have our bank account changed, because we had allowed this company to withdraw the $1500.00 out of it. The man at the bank called the number on the web site for US mortgage funding and they acted like they did not know Evan Lewis, but they did have our file, they also acted like they did not know that Citimortgage had turned. I fill like they should have known something and should have given us a call themselves. The lady that is suppose to be over our case is Joy Napolitane. Number 1-866-977-6950, I have no idea who she is, we have never spoken to her at all. It has been over three months sence we started this and now over a month sence we found out that we were turned down. I would like a full refund, and not only that, I would also like the $54.00 that we had to pay for the late fee on my last mortgage payment. That was suppose to be waived, nothing they said would be done was done. I feel that the people should be warned to put their money on something real and not to throw it away the way we did.
