Violations of RESPA, other federal statutes, and non-existent customer service corruption

My husband and I had a mortgage with First Nationwide Mortgage, a company that was bought by and merged into CitiMortgage, Inc.in the spring of 2003. Since this transition, CitiMortgage has lost an online payment, then a phone payment.

In violation of RESPA, they have charged excessive late fees, sent letters threatening foreclosure, made innumerable phone calls from call centers by people who are rude and have no authority to correct errors, and sent "address checkers" to our door who refuse to identify themselves.

Despite our previously perfect payment record, CitiMortgage pursued us as if we were deadbeats. They have contacted the Veteran's Administration with patently false information (e.G., behind 3 months when we are not behind at all other than the payment they have lost twice) and submitted false reports to credit reporting bureaus.

Despite our timely sent "qualified written statement" protesting their handling of our account, they have failed to meet response deadlines as required by RESPA. After many attempts to contact the president of CitiMortgage, I finally found his direct telephone number.

Calls to the president's office (as well as thoroughly documented letters) have netted nothing but promises to investigate and to return calls. Deadlines pass and no calls or reports are forthcoming.

I have learned that approximately 500,000 mortgages were transferred from First Nationwide to CitiMortgage and we would like to hear from other people whose accounts have been badly or illegally handled during this transition. Or, as the president of CitiMortgage said in his "Welcome" letter, this "exciting change". We wish we could share his enthusiasm, but we're not enamored with corrupt corporations.

We see no other option at this point except to sue CitiMortgage because of its disregard for RESPA, FCRA, FDCPA and other federal statutes.
