Foreclosure After Promised Refinance Never Happened Following Layoff

My wife and I were wondering if this could be a case of Predatory Lending. 2 months before we closed on our house I was laid off and when we spoke to our BOA rep to tell her that the mortgage would be more than my wife's net income per month she said we would be able to refinance to a lower mortgage. Well that never happened and we are now in foreclosure.
