Trying To Foreclose & We're Not Even Late! GMAC claims we didnt pay but our checks cleared the bank

GMAC Mortgage has ripped us off so bad. They took over from MGC Mortgage and claim we were 3 months behind in our payments. After continuous arguing and me faxing the "Payment Research Dept." 3 seperate faxes to try to prove that we had paid and our checks cleared, we still couldn't get any help. They then turned us over to their attorneys and were supposed to auction our home 04/23/09. They have returned our payments for Jan., Feb. And March. We've had to pay for an attorney to step in and stop their foreclosure, but we're hoping based on enough information where others have had the same problem to start a class action lawsuit. My current attorney won't handle this and says we can't make GMAC reimburse us our attorney fees, as their opinion is that it was our choice to hire an attorney. We had to or we would have lost our home.
