Overdraft rip off, beware of this new policy they call cash 21?

I have a business checking account with Bank of America, all of my collections almost evert other day goes EFT directly to the bank, all credit/debit card sales goes directly to the account but there is no mercy on charging overdraft fees. They charge overdraft fees before anything else even the accounts were not charged or cleared. The only basis is the pending authorization. Does anyone knows about this new policy? I was told by the bank that this is newly implemented and all banks are doing it. Which is not true, Suntrust will wait until the sale kick in or cleared. Its just make sense to get charged if there is no money in the account. This is the other thing, bank deposits are not counted, I was told Bank of America do not consider the deposits when calculating the overdraft fees, all they looked at the balance at that moment not when it was cleared. If there's any class lawsuit to get to, this is it. STOP ripping off consumers especially at this economy.
