On behalf of our client, Joseph Mazzei, we have commenced a class action in the U.S. District Court for the Southern District of New York entitled Joseph Mazzei v. The Money Store and TMS Mortgage, Inc. Plaintiff complains that:

The Money Store has engaged in misconduct in connection with servicing and attempting to collect amounts purportedly owed on residential home equity loans.

The Money Store attempts to collect attorneys fees and penalties before any applicable notice of default period expires and before it accelerates payment of amounts allegedly owing.

The Money Store falsely creates the impression that a third party (in this case, the Englewood, Colorado law firm Moss, Codilis) is involved in the collection effort when the debt collector does little more than send out a form letter on behalf of the Money Store.

The Money Store charges amounts for dishonored checks in excess of amounts it is allowed to recover.

The Money Store charges unspecified amounts for expenses of collection and attorneys fees and costs in excess of amounts it is allowed to recover.
