Not giving customers credit for payments and late fees! Abusive phone calls to people listed as your next of kin on your purchase application!

Beware!

Capital One is pulling anther stunt on customers.

Put everything in writing to both your Department of Justice, and Capital One's operating Department of Justice: CALIFORNIA, AND TEXAS. (send copies of your complaint to these states as well).

Not crediting their accounts with payments and late fees made.

We paid on April 14th, all of our back payments, $302.99 x's 3 months $908.97 and late fees $227.10 in full. This brought our account paid in full, and ontime. Our next payment wasn't due until April 30th, of $302.99 not late until May 9th which would then get a late fee of $15.00 dollars.

Capital One did not credit our account with the late fees.$227.10.

When we called them on it, they claimed they were "holding back" the late fees, until we made our NEXT PAYMENT on time.

This is illegal in most states, (and may be on the federal level as well).

So, turn them in...

When a company sends out a bill, with a breakdown of amounts due, late fees, additional charges etc. And the CUSTOMER PAYS THIS BILL, the company can not "RE-ARRANGE" the funds paid on that billing.

In other words, the company can't take the late fees, and add them to the next payment.

THIS IS WHAT CAPITAL ONE tried to pull on us. They took our late fees, and attempted to put them toward a car payment that wasn't late.

We called them on this, and the truth is, they could care less.

Also!!!

Capital One will "re-read" your origonal auto loan application, and attempt to abusively call any next of kin, or references you listed.in our case, the abusive called an 88 year old relative, and an 70 year old relative.

TURN THEM IN FOR SUCH ABUSE!!! In our case, our relatives hired an attorney, and wrote Capital One a letter informing them they were going to be sued in this conduct continued.

The calls immediately stopped, within 4 days of the letters being sent.

A note:

Go to complaint, and print off a couple of other complaints against the company you are having trouble with. Then send these to your Department of Justice along with your complaint. This lets your Dept of Justice know, that this is a growing trend with a company.
