Unfair Billing, Harassing phone calls, dishonest late fees

I had a car financed through Capital One in August. I did't have any problems with them at first but I noticed every month there was a late charge on my bill. I ignored it because I knew my payments were on time every month.

A couple of months ago I started getting about 15 phone calls a day at home and at work from Plano, TX asking about a late payment. When I checked my bank account, the check had already been cleared, but I was continuing to get the calls.

This made me start looking into the previous months and I found out that if a payment is not recieved on the due date it is considered late. Even if it is only a day. When I received my next bill it had $75 in late fees but the payment due was less than my original payments.

No one at Capital One could explain this. And the phone calls continued to come day and night. They would call me on my job every 15 minutes and then hang up in my face when I ansered.

I traded that car in last month because of all their harrassments. Now they are demanding that I pay them car notes until the dealership where I got the new car sends them a check.

When I explained to the woman that I had traded the car in before the payment was due, she said it didn't matter whether or not they got the full payoff amount that I would still have to send them $800 (how she came up with that fee I don't know). We argued for 30 min. While I was at work. She wanted to check that day.

She refused to let me contact the new finance company to see when they would get a check and told me that they would just later refund what I was owed. I know this is not true. She was very rude and said that I had 48 hours to get them the money. I called the new finance company anyway and was told that the check was already on the way to Capital One for the full amount.

Capital One still harasses me every day and I know they have gotten that check. But they keep telling me that it doesn't matter that I still have to pay them. Why? She could not get me an answere then she finally said, I'll just report you to the credit bureau.

I would advise no one to get a loan with them for any reason. The unnecessary phone calls alone will drive you into depression especailly when you haven't done anything wrong. Is there anyone who has filed a lawsuit against these people? Please let me know.
