Fraudulent over limit fee

I check my balance with capital one before i make any purchases. I made a purchase well under my credit limit 4 days before they processed my statement. When they put the finance charges on it threw my balance 3 dollars over limit so they charged me 39 dollars in an over limit fee.
When i called of course they have loop on phones that never takes you to a live person, so had to call back and just keep hitting zero until i finally got to a live person who said they would not reverse the charge of course. So it appears that what they say your purchasing power is at any given time is not correct even if you check it every day, besides how is it inside the law to charge a penalty on their finance charge?
