In December I ran into hard times and fell behind in my mortgage payments. I decided to refinance my home in Maine. My Loan Officer requested a payoff of my mortgage Dec. 10.30 days later no payoff. I and my loan officer made repeded attempts to get a payoff to no avail. My loan officer filed a complaint with the Federal trade commission and Maine consumer credit regulation department. Upon speaking with credit regulation, I learned any company servicing a mortgage in the state of maine has 3 days to send payoff, otherwise they are breaking Maine Law. Finally we got the payoff and closed Feb. 28 2006. Wilshire Credit added $1900.00 in fees, my escrow of over $900.00 and there was an overpayment of prepaid interest in the amount of $350.00. I gave Wilshire 30 days (which I would think is a reasonable amount of time) and I called to find out the status of my overpayment. I have once again gotten the run around, the woman told me the $1900.00 is held for a third party attorney (there was no foreclosure), so I requested the contact information for the third party. The woman proceeded to tell me she had no way of knowing that information. I asked to speak with a supervisor and she told me she did not have one and they would hold onto my money for as long as they see fit. This company owes me $3150. If there is anyone out there with any advice I would appreciate it.
