Harrassment, claims of missing payments, unethical ripoff

Green Tree took over my mortgage from CIT in Feb. 05. Started having problems in May 05. When this started there was a charge for insurance on my monthly bill, when I called and questioned this because I carry insurance through another company I was told that maybe it is escrow then and I should go ahead and pay it. I refused. I told them to either explain the charge in writing or take it off the bill.

In July the harrassing phone calls started full throttle and have not let up since. I constantly ask them to prove where any payments have been missed and they cannot. I was then told that my escrow was seriously behind and that I was in danger of loosing the house. I explained that property is only taxed at $578.00 per year and they are charging $156.00 per month and I think this is ridiculous. I was told that American Escrow is the problem and not Green Tree. I explained to them that American Escrow is not calling me 5 times a day.

In November my girlfriend was trying to figure out the situation and help out but to no avail. They then started to call her on her cell phone, and job and told her to pay because she lives there. When this did not work, they called my ex-wife at work and told her that girlfriend is impersonating her and that this is illegal. Green Tree then called girlfriend back and told her that they will prosecute her for impersonating wife. Called girlfriend back a few minutes later and asked her if she is scared and maybe she should pay bill so all this will just go away. Girlfriend said to do whatever they want, just quit calling her. They did not.

The collectors have called both of us at work, cell phones and at home. One day my girlfriend was actually on the work phone because Green Tree had called and her cell phone started to ring and it was Green Tree also. Collectors have even started calling from thier own personal cell phones. We are now seeking a legal remedy.
