I was contacted about visiting Sunset Resorts in Cancun Mexico. The fee was $599.00 for 5 days and 4 nights. The package was to be all inclusive for 2 adults and 2 children. My daughter had just turned 21 so therefore could not go with us. I was then told I could buy a lesser package for $299.00 which would cover accommodations only but we could have adjoining rooms. This I happily accepted.

The payments were to be withdrawn from my bank over the next 3 months. The first month all was as scheduled then for unkown reasons the second package was the only one taken in the second month. When I called to make reservations I was told that I would have to finish paying first then we could schedule our trip. I agreed and paid the complete balance which consisted of 2 payments on the first package and 1 payment on the 2nd.

After this was completed they then informed me that we could not do this as a family. My wife and I could go but my daughter would have to travel at a later date. They said I could not have 2 packages with one being all inclusive and the other not. At that time they wanted $300.00 more for my daughter. When I refused they then said they were sorry but nothing else could be done.

I continued persuit to get my money back and then the offer was made that they would refund the $299.00 and charge me $280.00 to include my daughter in the original package. I somewhat agreed but then they wanted the $280.00 upfront and refund the $299.00 later. I refused at this point to give more money.

Later I recieved a phone call telling me that if I would sign an agreement they would refund the $299 but I would still have to pay upfront the $280.00. I signed this and faxed it back but now they say it will be somewhere in the time of 10 maybe 14 business days before the refund will happen.

I not only will not go at all now because of the broken trust but have very doubtful feelings I will get any of my money back. They have already told me the $599.00 is not refundable and that if I choose not to go there I can give it to someone or sell it. I would not subject anyone to this kind of deceit.

Is there any legal recourse for the deception? The packages were puchased in good faith with the intention of a family vacation but now has become a nightmare.
