In July I ordered 2 international business class airline tickets. The cost was about US$6100. When I saw the charge on my credit card statement, it was 6,100 Euros which at the exchange rate of US$1.33 is US$8,113!
I was overcharged by $2,013. Of course, I called 1st Air on the telephone and the operator (who sounded to be overseas from the very bad phone connection) always said someone would call me back. Nobody ever called.
Since 1st Air never called me back, I FedEx'ed the tickets back to 1st Air. FedEx could not deliver them because they said the address for 1st Air was actually a gas station. They left them at the gas station and someone eventually collected the FedEx (I don't know who).
1st Air never replied to my Fed Ex letters, phone calls or e-mails (unlike when I ordered the tickets where they were happy to take my credit card!) so I charged back the amount with my bank.
I thought it was over until today when a process server served me with a LAWSUIT from a travel agency in Portugal, Solseta Travel who actually issued my tickets in Euros.
The lawsuit, from Solseta Travel, Ltd.in Almancil, Portugal was against 1st Air, me and 31 other defendants (customers of 1st Air) who were also ripped off by 1st Air.
I was unhappy to see my entire itinerary, along with the itinerary of the other 31 innocent travellers, listed in the lawsuit. This should be against privacy laws to list the travel plans of all these people.
They lawsuit is claiming $249,000 from 1st Air and/or the 31 defendants (travel victims). Solseta Travel seems to be suing the travellers who bought tickets on 1st Air because they can't recover any money stolen from them by 1st Air.
Oh, the lawsuit also claims that the customers (myself included) signed a paper from 1st Air that said "the rules require that where ever the ticket is issued, if there is a difference in fares, the higher fare shall apply" in case the ticket was issued in Europe.
The fine print that 1st Air had their customers sign might have made them think that they could quote in US$ but charge in Euros, but 1st Air will be sorely disappointed after Attorney General Mario Cuomo locks these people up as this entire operation appears to be a massive fraud on travellers.
The worst part is 1st Air is still in business!
