Ripoff my deposit money and use of dishonest and unfrofessional matters

In May I was in a process to buy an apartment from Marie-Lise Archer-Douge that was represented by her brother Alex Archer as her real estate agent. I gave Remax Real Action, Inc. My real estate agent a deposit of $5,000 that was put as a first deposit in an Escrow account.
As a result of an unprofessional performance of my mortgage company that could not reach the closing date (May 31st), the seller decided to sell the apartment (I have never signed for releasing the contract).

The seller sold the apartment higher than the rate we close on, but still does not agree to sign for the release of my money from the escrow account. The seller and her real estate agent (her brother) claim for the money even though I received a denial from the mortgage company. Their excuse for not releasing the escrow account is the fact that the seller had to stay in the apartment longer than she thought.

Since June I had no place to live and had to move from one place to another. I rent a place on a monthly basis and paid $1,200 per month. As a result of the situation I left my work, my boyfriend left me as I got into deep depressions and couldn't stop crying. Now, finally I rent an apartment and try to keep on with my life, Please help me to get my money back.
