Conflict of interest, misrepresentation, inflating the value

A home listed in the midtown area of Stockton had a flyer with a listing price. We called to see the property and was told by the agent that the "seller" had already turned down several offers. He said he "knows the seller very well and had represented the property several times in the past."

We asked to see the interior of the home and was told it was being sold "as is". When asked if the seller would entertain offers of less that the asking price the "agent" said, "no." We went home to think it over and decided to place an offer meeting the asking price. When meeting with the agent to place the offer the agent stated that "the seller is my brother, who is also 1/2 owner of the company, but we don't allow him on the business premises as he is very difficult and unreasonable to deal with." The agent did feel that the offer had a very good chance of being accepted."

This was placed on monday and on friday afternoon the agent called and said the seller is countering with "290k". The original asking price was $275.

This situation is clearly a conflict of interest! The agent made other comments while viewing the property such as "it is worth at least 350,000 but the seller wants out and doesn't want to do any repairs or pay for points, so he is letting it go for much less...

I don't think anyone should want to do business with this less than honest real estate agency.
