This is a rare scenario that involves a third party custody case. My wife and I were granted custody of a minor child in the fall of 2010. The childs biological grandmother was given liberal visitation, in spite of doing nothing to contribute to the welfare of the child, and not attending the custody hearing. Unfortunately the childs mother has been missing in action for over three years, and the biological father has never been in the picture.

In the first week of my wife and I received a letter from Mr. Golomb stating that he represented the grandmother, and we were allegedly denying the grandmother visitation. He also stated that he represented the biological mother, and that they were looking to vacate the custody order due to the fact that she never knew we were seeking custody.

A hearing was conducted in February. On the day of the hearing while waiting for the courtroom to open we were approached by Mr. Golomb, he questioned if we were his clients or not. This guy didnt even know who he was to represent! Testimony was heard in the case, the motion to vacate the custody order was denied.

Three days after the hearing, I discover that the grandmother is now seeking custody of the child. My wife and I of course are named as defendants, and so are the biological mother and father. And Mr. Golomb is representing the grandmother. This sounds suspect, right?

My wife and I were dragged through a senseless discovery process. Finally, we were given a scheduling hearing in December. On the day of the hearing the childs biological parents were not present. This aggravated the Master, as he was under the impression that the biological parents were seeking custody, not the grandmother. During the scheduling hearing, Mr. Golomb was scolded by the Master as he discovered that he had previously represented the biological mother in February, who is now named as a defendant in this case, which brings a conflict of interest.

Feeling the heat, Mr. Golomb suggests to the grandmother to settle out of court. She refuses. So now a court date is set. To make matters worse, from his standpoint, the court decided to join the history of both cases together. This means that it will be noted that Mr. Golomb represented a client, whom is now a defendant.

As of the beginning of in a last ditch effort to save himself from trouble, Mr. Golomb has filed a motion to remove himself from representing the grandmother. If you ever need an attorney, dont hire this guy, he will take your money and then leave you.
