Charlatans ripoff of $130.00 for undelivered goods! Internet

I ordered solar lights in the amount of $130.00 from overstock.com in December. Their carrier was Fed-Ex. The goods were never delivered to me. Fed-Ex said it was "delivered to address other than recipient's". I called overstock.com on 14th May and requested their assistance. They said that they would "check their warehouse and get back to me". On 21st May, I called them again when I had not heard anything. They said that Fed-Ex's policy was that I had to report within 90 days and I was out of time.

I explained that this was clearly Fed-Ex's fault and they could not rely on that clause. Two separate "SUPERVISORS" refused to help.

After 1.5 hours and several telephone calls to overstock, I decided to call Fed-Ex myself. After 5 minutes, 2 customer service representaives and one supervisor (all of whom were very pleasant) I learned that the time limit was NINE MONTHS not 90 days.

I called overstock.com again. HALF AN HOUR LATER (after being put on hold), a rude, snippy, uncooperative "supervisor" came to the phone and said that the policy was 90 days. I informed her that Fed-Ex said it was 9 months and asked if NOW they would help their customer. She called Fed-Ex (or so she said), came back and told me they did say they would honour the claim; and that she would check with her warehouse and get back to me in 3-4 days.

SHE HAD NO SHAME over the fact that she nor anyone else in her company knows the terms of their contract with their shippers! When I compared her shoddy and laughable service (and I use that term loosely) with amazon.com, she told me point blank that I am free to shop with amazon.com. I advised her that no-one I knew would ever be shopping with overstock.com again.

This matter is not over, but after reading the other reports here, I do not believe that I will get any satisfaction from overstock.com except through litigation. I do not see the need to "check the warehouse" when Fed-Ex has clearly stated to me, and to them, that they will honour the claim. Unfortunately, I have to rely on them (overstock) in order to get the claim filed with Fed-Ex as they, not me, are the shipper. Believe me though, I will be posting/reporting/filing reports on usacomplaints.com, cnet.com, and any other place I can (including the courthouse) about these people and their CROOKEDNESS!
