Entered into a contract that was illegal

I entered into a contract with Neotel in 2009 to provide a telephone and internet service. Unbeknown to me the service for which I signed a contract was not available at my address. Neotel however signed the contract, took my money every month while I struggled with continual dropped calls and internet connection.

I eventually found out that the specific service i had signed a contract for was not available in my area. After 11 months of frustration I cancelled the contract only to be charged a cancellation fee. They have subsequently refunded this.

My question is it legal to enter into a contract knowing you will never be able to deliver according to the terms of the contract. Secondly why would they not refund me my 11 months of payments? Their answer was tha I had had some service, even if it was not what I had signed a contract for.

The small guy can never go legal on a case like this because your costs would be more than what your claim is, so one loses out.

I would just like to warn anyone wishing to take out a contract with Neotel, ensure that your area is covered by the service for which you are contracting. If you make the mistake I made you can kiss your money and service goodbye.
