After changing our mind to lease a space, the company doesn't want to give us our holding deposit check. We haven't sign anything with them

Hello, my wife and i were interested to lease a space. After meeting their agent we decided to move one step further, we had to give them a deposit cashier check (first month and deposit;$3995) to hold the space along with giving back the credit application. The agent specifically said that the company would hold the check until we signe the leasing contract... After visiting the place twice we decided to that the place wasn't for us, also the sample leasing contract that the agent gave us didn't look right.
So we called them to let them know and our own biggest surprise they deposited the check already without us signing anything!!! Even the credit application wasn't signed (forgot to sign it at the bottom).
It has been 2 months already, and they don't want to give our deposit money back!!!
This is a total fraud, those people shouldn't be in business...
