Verizon Wireless Charged me $44/month (over 12 months) for a data plan without my consent

I upgraded my phone (Samsung Omnia) around 12 months ago. When I purchased the phone the sales rep told me that the phone required a data plan. I told the rep that I did not want the data plan and that I would purchase the phone if I'm given the option of declining the data plan. The rep said that it was possible to do so and so I went ahead and got the phone with the 2 year extension plan. When I got my first bill after the phone upgrade, I noticed that I was getting charged $44 for a data plan. I called Verizon and complained about it and asked that the data plan be removed. The rep told me that it was a mistake and that it was taken care of. I was satisfied since I thought it was an honest mistake. I never checked my Verizon bill after that until 2 days ago when I noticed that $44 charge was still on my account. I called Verizon and asked them about the charge and it turned out that I was being charged $44 for a data plan over the course of 12 months. So the rep never removed the plan out of my account. The rep that I spoke to yesterday refused to cancel the data plan and refused to refund the money that I had been charged for the plan over the 12 months period. I told the rep to play the original recording of when I purchased the phone and she refused. I kept arguing until I got frustrated and started yelling and that is when she just hung up on me and refused to give me her full name. I called again and requested to talk to a manager and I was promised that someone would call. I haven't from anyone yet.
