Allows sellers to use tactics that violate state law as well as policies of major credit card companies

I noticed several merchants ads stating that purchases made using credit cards would be charged an additional 3% over cash purchases. This violates policies set by all the major credit card companies. It also violates the law in several states! When I attempted to point this out, this was the response I got.

A Texas seller's ad states an additional 3% will be added to selling price if buyer uses a credit card. This violates Visa's policy AND Texas state law. "TEXAS POSSESSES A "NO SURCHARGE RULE" FOR CONSUMER PURCHASES "[A] seller may not impose a surcharge on a buyer who uses a credit card for an extension of credit instead of cash, a check or a similar means of payment." Since we do not take part in the financial transaction, you will need to address that with the seller. Further, as we are not party to the agreement between the Seller and Visa we cannot speak to its Terms and Conditions.

So if a seller posts a policy that is an obvious violation of the law, you don't care? Fine, I'll notify the Texas and Georgia authorities myself. As far as Visa's policy, that is a constant with every merchant. If you accept visa, thats the policy. There is no bargaining...
