Joaquin (agent) scare tactics in

I had a mortgage with National City Mortgage, which became PNC, which was sold to Green Tree Servicing LLC., a couple of weeks ago. I have fallen on hard times as have a lot of people in the country, and have found it very difficult to pay my mortgage. I tried getting my mortgage modified, using the Obama plan. But it just does not work in California, because the housing values have dropped tremendously. So I have decided that I will just do a short sale. I originally contacted National City Mortgage and they were very helpful with what I need to do to get my short sale approved. I was going through the process when my loan was sold to Green Tree. Now I have an offer and the entire package together, via my real estate agent to get the house sold.
Saturday morning after Thanksgiving 2009 I received a phone call from Joaquin from Green Tree, calling me by my first name like he knows me. He proceeded to inform me that his company now has my loan, and he wanted to know what my intentions were for the house. I told him that I have an agent and that she has submitted a hardship package and offer for a short sale to his company earlier that week. He told me that my agent hadn't done anything and he wanted to know when I would be making a payment. I slowly said again to Joaquin that my agent had submitted the package already and maybe he just hasn't received it yet. He proceeded to yell at me and tell me that I am past due on my payment and he expected me to send in a payment immediately, and furthermore I would not be selling the house unless HE approved it. I told him that I was selling the house. Period. He then became unglued and stated that he would be putting my house in for foreclosure. At which time I hung up the phone.
I told my agent what had happened and she tried getting in touch with his supervisor. She also told me that Joaquin is unfortunately the loss mitigator that we would have to deal with, and that he wanted me to call him back. When I called Joaquin back he started in on me again, only this time he told me that he had received my package for the short sale, but he would not process it unless I make a payment, and if I don't make payment arrangements with him, he would foreclose my house.
This guy should not be allowed to work with the public, and Green Tree is in for a lot of trouble if they keep up these practices.
