On April 27, MegaColor agreed to print 3000 PB books for $11,575.00 for Firelight Books. As per the agreement, we paid $5,787.50 on 4/28/09 as a good faith deposit.in total 1500 books were received.
There were significant problems with the quality of these books and delivery was rejected in a timely manner. These problems included, but are not limited to: pages falling out, exposed glue, and globs of glue causing rises in the side seams of the books. The problems were promptly reported to MegaColor. MegaColor assured us the problems would be remedied. Matthew Hershkowitz and Dave Hershkowitz agreed the books were not close to industry standards because of machinery malfunction.
MegaColor picked up the books, but did not make good on its promise to reproduce and deliver satisfactory products. Due to the unsatisfactory condition of the product and MegaColors failure to correct the issue in a timely manner, we were forced to mitigate further damages and have another company print the books in order to fulfill our commitments with our customers.
Although MegaColor failed to satisfactorily execute their duties under the terms of the agreement, our AMEX was automatically charged the balance of $5809.50. We have regularly contacted MegaColor since that time regarding the status and resolution or this issue, speaking with Dave Hershkowitz and Matthew Hershkowitz. Both assured resolution. Offers to make the books spiral-bound and cutting off the sides of the books were not workable solutions for us.
We have been out $11,575.00 plus interest and we have no product. We have given MegaColor about six months to refund $11,575.00.
