Falsely representing local yellow pages ad

This company called my husband and the caller spoke with a heavy accent asked him to verify info for the yellow pages ad. My husband had an ad in our local yellow pages at that time and my husband thought this was for the local ad (he kept asking the caller, "don't you already have all this information?") this was right before the local ad was due to be renewed and he asked her several times to repeat herself.

We never received a bill and today i received a call with them threatening to sue us over an unpaid debt for an advertisment in the official yellow pages. When i stated we pay the bill for the real yellow pages, he told me "no this is the official yellow pages". I told them they have never called either and he said he called me monday and the debt had to be paid by today or they were filing suit in court. He told me he left a voicemail monday (the 17th) although we never received one.

They played the taped phone conversation for me and i did state it sounded like my husband was unclear who they were but that he must have thought they were our local ad. I began to cry and he kept telling me the debt needed to be paid today or else they would sue us.

He then said he would contact the official yellow pages to see if they would take less than the $786 we owed them, he put me on hold and when he came back stated the lowest they could take would be $600. The supervisor also got on the phone and said they had called numerous times and sent bills although i said we never received any bill or official letter saying it was being turned over to collections. The supervisor was extremely rude and had me hysterically crying.

My husband reminded me later that we had received a call from a female with this company a few months prior and she was wanting to collect and my husband asked to listen to the tape with her and they listened to it together and my husband pointed out several times that he questioned the operator. After the call was finished, the lady agreed the call had been misleading and he had clearly been under the impression that this was the local yellow pages.

She agreed to stop calling and that this was misleading on their part. My husband called them when he got home and they stated they are suing us. I called the federal trade commission and plan to call the ny better business bureau in the am when they open.
