In Christa Buggey worked as an owner liason for Centex Inc. At the Pointe West Resort on Galveston Island's west side.in that capacity my wife and I were very happy with her performance and eventually we became friends.

At the end of Christa and I communicated and I could tell that Christa was very upset, having been dismissed by Centex just before Christmas. I felt sorry for my friend and I encouraged her to go into her own rental business.

Christa took my advice and I gave her one of my two furnished condos to manage. Christa also obtained other units to manage. Christa happily reported that business was good and my condo was making money. I was to receive my first quarterly check in September. Christa sent us a small check - a little over $200-representing a very small portion of our revenue. We were flabbergasted when this tiny check bounced! Christa told us to put it through again and it bounced again! This check was never made good.

I requested a copy of all of my rental statements. According to Ms. Buggey's own statements, she had collected over $11,600 in rents from our condo and after much nagging, we received a total of $234 representing a November rental.

Christa finally explained to us that the IRS had wiped out her account and that she had no idea her husband was in trouble with the IRS. Christa further promised to pay us as soon as she got a new job. I informed Christa that our money should have been in a trust account and that it should not have been under her name. I asked for the telephone number of the IRS agent and Christa said that the agent would not allow his number to be given out.

I was very surprised when Christa contacted me in January of this year ('08) to report that she had found a new job and was going to start making payments. Since she had contacted me, I actually believed that she might come through this time. As the date of the promised payment came closer (Feb. 15), the "I will pay you" became "I will TRY to pay you." At that point I knew that the likelihood of Christa ever paying us was about as good as a snowball surviving in hell.

I did some checking and discovered that Christa did not have a real estate license. I also found out that I was not the only "victim". There were, in fact, several other parties who did not get any money either.in my opinion, she had co-mingled our funds with hers. As explained earlier, she had also sent us a check that bounced TWICE.

After all of this, I thought the police would be very interested. Well, guess what? The police said that since we had a written agreement with Christa, that fact made it a civil case but I should cheer up because I had a GREAT civil case.

Next I contacted a local attorney and asked about our "great" civil case. The attorney agreed that we would no doubt win the case, the problem is collection. I was informed that I could not lien her home nor could I garnishee her wages. This is quite different from my home state of California - which I thought was a liberal, deadbeat haven before I heard about Texas.

Somehow, I could not see spending money for an attorney to obtain a judgment I had little hope of collecting. Christa had told me that she had an attorney friend advising her and I believe she reneged on her promise because she had been advised about all of these loopholes.

The fact that it is so difficult to obtain justice in such an outrageous case as this really amazes me. It really makes me angry that I must resort to a forum like this to (maybe) obtain justice in a so-called "civilized" society.

Although she did wrong, it is not my intent to hurt Christa, but only to obtain what is rightfully ours. It is not good for her to get away with something like this and it is not right for us to have to suffer such a blatant injustice.

If Christa makes it right, I will be happy to report it in an update.
