Took Money and Failed to Ship Drums

I ordered a Pearl Snare drum for my son's birthday on the 5th April
I received an email on the 5th May then another on the 1st of June both saying the item was back ordered and shipment would be delayed.
I rang the company on the 5th June and was told the item would not be restocked and wasn't back ordered at all.
I checked the website and found the same stock item under another item number. The published price was now higher than the price I had paid for it. The item was only available in the color black.
I rang again on the 6th June and advised that I would take the same item in the color black (instead of Maple) as it was listed in stock on the website. (item 750552). Customer service confirmed this was available.
I have rung and left 3 messages with Charles - extn 2451
I rang customer service and was referred to 2 different people.
One (Charles) said I could have another pearl item that was in stock (a cheaper priced item than the one I ordered)
Another (Mary) said that even if the stock was available they couldn't ship it to me as the item is a Pearl drum and unable to be shipped outside the USA. She said check the website FAQ's
I checked the website FAQ and it didn't list Pearl. I take it that Mary is misrepresenting the truth.
As this is an item for my sons birthday day that has come and gone it is causing me personal distress.
All I want is the item that I ordered so I can give it to my son for his birthday. Is this too much to ask.
