Installed a window of a size smaller than what we requested and now are lying and claiming we requested the smaller size and refuse to make any attempt to rectify the issues claiming it is our fault

Back at the end of April we ordered two replacement windows for our home. One was a small window for our basement with which there is no issues. The second was what they referred to as a three-part-slider that replaced the two standard windows that were in our dining room. We requested that the window be raised slightly to accommodate new counters we wanted to have installed on that wall. Along with the salesmen that came to our house we agreed that we wanted the window to come down right above the counters which would raise it up about 7 inches.

When the technician came out to measure he marked on our wall where 40 inches from the floor would be, which my husband agreed was high enough to accommodate the counters. After this the technician left and we heard nothing else from Capital Remodeling until they scheduled our window installation. We were never contacted to confirm window sizes or anything and were never told what size window was being ordered.

When the window was put in we noticed that it was well above where we were originally led to believe it would be making the window almost 7 inches to short. When we contacted Capital Remodeling we were told that an addendum we signed specifically said 14 inch build up to make room for the new counter (this addendum was not presented to us until after the measuring technician had already came out) since we were never provided with window measurement we didn't realize that this would make the window smaller.

In addition the addendum did not state that this would make the window smaller then we had originally discussed. When we pressed the issue with Capital Remodeling they sent the technician that measured back out. At this point he told us he measured 40 inches from the top, not 40 inches from the floor, again something we would have noticed if we would have been provided with some type of measurements of the window or how it was measured. He also told us that they added extra space to accommodate trim and outlets below the window, neither of which we asked to have the window size reduced to accommodate.

Capital Remodeling basically told us that it was our problem because we signed the addendum that referenced to the 14 inches, which again had no window measurements on it, and if we wanted it fixed we would have to pay for a new window. The 2 windows we purchased cost just about $4000, for that kind of money I expect to number one to get what I want not a window they changed because that's what they felt I needed and number two I expect to be satisfied when I pay that much for something.
