EAS, Clear My Record, Remove It Do not bother paying hefty sums to these people to clear your record, you can do it for free on your own!

I have a Habitual Traffic Offender record that's 7 years old. I contacted 3 separate lawyers and learned that because I had been convicted, I didn't qualify for an expungement. Note that if you've been convicted and a verdict of guilty was given, you don't qualify for expungement. Only if the verdict of guilt was withheld or dismissed, do you qualify.

However, in doing a search over the Internet I came upon Expungement Assistant Services (EAS), a service which promises (heck, it guarantees!) that they can clear your record in all circumstances.

I called 800-870-1617 on October 23 and upon explaining to the sales rep my case, he said EAS could clear my record via expungement. I signed up with them for expedited expungement service and paid a total of $686 ($400 flat fee, $250 expedited fee for 30 days processing, $36 for document retrieval). As part of the process I filled out a webform with the particulars of my case.

I was assigned Shannon Richmond as the rep who would handle my case. EAS protocol per their welcome e-mail is:

*3-5 days for preliminary prepping*10 business days to receive your Notice of Intent to Expunge (this is a document that says you intend to expunge your record NOT that it's been cleared... Suppossedly you can show this to prospective landlord or employers. Honestly, you can put this together yourself, it is NOT an official document filed with the State)*4-6 weeks discovery period for our staff regarding your case (unless you are a Rapid Process client). Your records willbe requested and reviewed

So according to their protocol and because I paid for rapid processing I should have been looking at December 1 for the completion of my expungement. Right? Wrong.

For starters I had to send them copies of my record (which I purchased separately). I thought that's what the $36 charge was for. Apparently not.

From then on, I kept calling Ms. Richmond and leaving messages for her with the answering service. Not once did she call or write back with the status of my case.

On December 23, I sent an e-mail to her srichmond@clearmyrecord.com, CC: srichmond@removeit.org, info@clearmyrecord.com asking for an immediate reply or I else I would be forced to initiate a complaint with my credit card company to get the filing fees refunded on the basis that no service had been provided to me.

Then, her supervisor Brian called me, said that they were late in doing things because of the holidays and told me I qualified for clemency. A week later I got a package in the mail with a semi-prefilled clemency form (that you can download for free from your state's website; the form is really easy to fill out so don't think EAS is doing you any favors).

The package contained instructions on how to put together a packet (7 reference letters, documentation for school, volunteer work, and copies of records and judgments) and mail it to the office of Executive Clemency in Florida. You can save the $686 and do all this for yourself for free.

I am currently requesting to have at the very least the $250 expedited fee refunded to me. But frankly dealing with EAS if a big waste of time and money.
