Ripoff Trying to bill for sevice not provided!

Well having read the other reports I can see that I'm not alone. I don't know if anyone else has the exact same problem; but I smell a class action suit coming.

I was satisfied with thier service for the most part. I had them billing a credit card for DSL.in november the credit card in use expired.in december when they were unable to collect they shut off my service. No phone call was made to me prior to this happening.in all fairness they may have sent an e-mail to my earthlink mailbox which I never looked at.

I was being solicited by Bellsouth at the time for a better rate. So I took it. Fast forward three months...

I get a bill from Earthlink for $123.00 for 3 months service (after they shut it off). To dispute a charge I had to call between 8:00 - 12:00 mon - fri (nice hours). I gave up after waiting on hold for 20 minutes.

Not long after that I was contacted by CVS (a colection agency) who wanted to bill me $123.00 on behalf of EARTHLINK. I told them that I was not inclined to pay $123.00 for nothing. They informed me that any dispute must be sent by fax or mail.

Not a problem. I sent a fax describing the situation and attached part of Earthlinks own agreement that states that If I don't pay, they shut it off and the agreement is over. It doesn't say that they get to keep billing me.

In any case, a contract means they provide a service and I pay for it. If they don't provide the service then the contract is over BY THIER OWN DEFINITION.

You can guess by now that it didn't end there. CVS said that wasn't good enough (is anything?); and I'm still being contacted by them. I told them it's not the money; it's the principal. I told them if it shows up on my credit; I'll seek legal counsel. And I will. So now the waiting begins...
