Ripoff took $21,000 won't come back to finish the work won't respond and left a mess

Nelson Gil agreed to remodel my family room, utility room, and bathroom. He agreed to purchase material and provide labor. Total job cost $28,000. He required 3/4 of the money at half completion. He did some plumbing, put beams and coffer ceiling partially in and said half the work was completed.

The basement is a mess, ceiling and walls are not even completely drywalled and spackled, bathroom is only framed with only half the plumbing completed. He has taken $21,000 and said he is broke and needs me to buy the materials which is not what we agreed to. He started this project October 3 - he has not been here more than he has been here. He has only work about four weeks out of four months. He has taken most of the money, left my basement in a mess, has purchased very small amount of materials (i.E., dry wall, wiring, few plumbing supplies), he won't come back and finish the work, and won't answer my calls.
