Allied Interstate Possible violation of Fair Debt Collection Practices

Approximately 5:00 P.M. On 11/08, I contacted this agency regarding my wife's and our request that we were declaring chapter7 bankruptcy and told the gentleman (forgot his name) that my attorney requested that any further contact be sent to her office, and not to me.

Well, he proceeded to curse at me and threaten me, and even told me that my wife and I were unable to file bankruptcy, and that our cased would be dismissed. I told him that I simply wanted to give him the address to our attorney, and he started cursing and said he would call our "Ambulance Chasing" attorney and see for himself.

He also told me and my wife that we just needed to pay them and stay in our trailor. He said that they would take our cars and when the court dismissed our case, he would sue and get "all he could get" from us.

At this point, I advised him that he just broke one, if not two of the Fair debt collection practices laws, and he said I wasn't smart enough to prove it. He also told me that he would call 2 times a day, even on sundays until the debt was paid. I told him that this was fine, cause I could just change my number, as harrassement was uncalled for. He also told me that his company doesn't have to abide by the bankruptcy court's stay, and they will and can protest this debt, even though capital one had no problem with us declaring bankruptcy.

In then end, the collector was getting so loud and berating that I just hung up on him. I then called back and relayed all this information to a supervisor, who was very nice, and she apologized and said that the collector that called me had several complaints already today, and this wouldn't happen again.

Did they break any laws? Is this level of harrassment expected? Just wondered if I did the right thing.
