Item lost after delivery and refused to send another or refund my money - Madden 25 for Xbox 360

Ordered Madden 25 for Xbox 360 on 11/28 from Microsoft Store online. Due to various delays caused by weather, delivery was not attempted until 12/11. When I got home, the item was not in the normal place left by the delivery company. I have spent 8 hours on 10 phone calls trying to get another copy sent to me or have my money refunded. The delivery company said they would handle the lost item per the shipper's agreement with Microsoft. Microsoft has told me at various times that "it has been sent to escalation" and that I would need to wait 24 hours, then 5 business days, then 8-10 business days, then 24 hours and finally back to 8-10 business days for a resolution. I repeatedly asked to speak with a supervisor and was denied every time. I just want the game for one of my son's Christmas presents or refund the money back to me. I have never seen a company refuse this request.
