BestApts NYC Rip Off, Scam, Horrible Business Conduct

We've looked at an apartment with one of the Realtors (Ethan Sprague) from Best Apartments NYC, on a Saturday evening. He was very talkative and hustler like, he managed to talk my mother into going down to their office at 6pm and taking out $300 cash out of the ATM for an applications fee (each applicant=$100), I and my mother signed the application and he had to come to our house first thing on Monday to collect the third applicants signed form etc. Unfortunately we gave him the whole $300. On Monday he stopped by, said we were his first stop and when we informed him that we can no longer take the apartment (because the 3rd person was unable to provided a letter of employment -which the realtor was aware of), he tried to wiggle himself into renting our current apartment where we live in! When I tried to ask for our $300 back, he said it
was nonrefundable and it already went into the application fees! I tried to be reasonable stating that we are at least entitled to the $100 for the 3rd applicant that never gave him his signed form, and how in the hell did the fee go for the app. Processing over night on a Sunday, not to mention that he could not have sent out an incomplete application?! He refused to give us any money back, instead proceeded to send me aggressive email, threatening to sue me for $5000 for his broker's fee -when we never even signed anything regarding his broker's fee, surprised he had the guts to threaten me, suing me for something that doesn't even makes sense would cause his company a lot of $. This person is mental, and his manager (Bridgett) would not help or try anything to resolve this matter. We truly feel scammed and things like this should not go unresolved.
