Breach Of Contract

We negotiated a cost of $14,000 for a Mohawk Premium Rev Wood Waterproof laminate flooring, which included materials, labor to remove existing flooring, moving of furniture, installation of new flooring, and new wood ¼ round. The flooring was 7.5” by 47.25” by 12mm thick in Sand Dune Color.

We paid $7,000 down and were scheduled to pay $5,000 upon delivery/the day the installation started, and the final $2,000 upon completion of the work. They arrived at the house with Mohawk Rev Wood Select Waterproof laminate flooring 7.48” by 47.24” by 10mm thick in Sand Dune Color. I immediately contacted NFD Customer Service to inform them of the error.

We waited over three weeks to get the flooring in. To avoid waiting another three weeks for the correct flooring to arrive, I attempted to negotiate with them on the price, since the flooring is 83% the thickness of what I ordered (10mm vs. 12mm). They offered me a $200 discount. I said I would not settle for anything less than $1,500. They finally came up to $700 and said that was the best they could do.

I explained that they were in breach of contract, as they agreed to deliver 12mm flooring but delivered 10mm. They stated that Mohawk had upgraded their flooring and the newly modified flooring was a superior product, and they no longer manufactured the 12mm. I said I would not accept their offer and would appreciate a refund of my $7,000 deposit. They stated that they would not return my deposit but would allow me a $7,000 credit with NFD. I asked how to go about getting my deposit, and they stated to "have an attorney send a demand letter."

ORDER TERMS AND CONDITIONS

Prior to the commencement of installation, all materials are to be inspected by the customer or the designated responsible party. Once the customer or their designated responsible party affirms that the correct color, style, and quality of materials are on site, installation will commence. After installation commences, no claim for color, style, or quality of materials will be accepted.

They had a class action suit in New York for these same issues.
